These Terms and Conditions govern the use of Book-Go.eu and the transfer booking, offer comparison, administration, communication and payment services available through the platform. Their purpose is to clearly define the rights, obligations and responsibilities of the Customer, Book-Go and the independent transport service provider.
The Customer must review these Terms before completing a Booking. Where specific conditions have been expressly accepted by the Customer for a particular Booking, those conditions apply together with these Terms and, to the extent permitted by mandatory law, prevail over any conflicting general provision.
1. About Book-Go
Book-Go is an online passenger transfer booking and offer comparison platform based in the European Union that connects Customers with independent passenger transport service providers.
Book-Go provides booking, offer comparison, booking administration, communication, customer support, payment organisation and administration functionality and other services related to operation of the platform.
Book-Go is not a passenger Carrier and does not itself physically perform passenger transport. The Transport Service is provided by an independent transport service provider that, according to the applicable booking model, assumes the transport obligation or actually performs the journey.
Book-Go remains responsible for its own platform services and for its own legally attributable acts or omissions to the extent provided by applicable law.
Book-Go's legal operator and contact details are stated in Section 55, “Contact Details and Platform Operator”.
2. Definitions and Structure of Contractual Relationships
Customer — a person who makes a Booking or enters into a transaction through the Book-Go platform, including where the Booking is made on behalf of other passengers.
Passenger — any person travelling under a particular Booking.
Carrier — an independent transport service provider that assumes responsibility for the Transport Service entrusted to it.
Contracting Provider — the transport partner that, under the applicable booking model, assumes the transport obligation towards the Customer, even where the final Performing Carrier is determined later.
Regional Contracting Partner (RCP) — a Book-Go partner for a specified market or territory that may assume the role of Contracting Provider, perform the journey itself or, where permitted by applicable law, arrange its performance through another suitable Carrier.
Performing Carrier — the service provider that physically performs the journey, regardless of whether it is the Contracting Provider/RCP itself or another appropriately engaged Carrier.
Driver — the natural person assigned by the Carrier to physically perform a particular journey.
Booking — a transport order confirmed through the Book-Go platform in accordance with the applicable booking process.
Transfer Price — the price displayed to and accepted by the Customer for the particular booked transfer, excluding separately and clearly identified optional additional services selected by the Customer.
Advance Payment — the part of the Transfer Price paid by the Customer during the Booking confirmation process. Unless otherwise stated in the Booking, Book-Go's standard Advance Payment is 20% of the Transfer Price.
Remaining Balance — the part of the Transfer Price that remains unpaid after the Advance Payment.
Book-Go Service — the platform, booking, marketplace, administration, communication, payment organisation and related services provided by Book-Go.
Transport Service — the actual passenger transport provided by the Carrier.
Full Payment Protection — an optional Book-Go payment and payment-protection service, the terms of which are described in these Terms and in the checkout information for the particular Booking.
Depending on the applicable booking model, the legal and commercial relationships involving Book-Go and the Transport Service provider may be separate. The fact that a Booking, communication or payment is administered within a single Book-Go interface does not in itself mean that Book-Go physically provides passenger transport.
3. Applicable Law and Regulatory Compliance
Each Transport Service must be performed in accordance with the mandatory laws, licensing requirements, passenger transport rules, road traffic rules, vehicle-capacity restrictions, insurance requirements, safety requirements and transport-documentation obligations applicable in the country or jurisdiction where the journey takes place.
Different types of passenger transport may be subject to different regulation in different countries and even within the same country. The Carrier is responsible for identifying and complying with the rules applicable to the particular journey, including obtaining and maintaining all necessary licences, registrations, permits, insurance and Driver or vehicle authorisations.
Neither Book-Go, the Customer, a Passenger, the Carrier nor the Driver may require another person to perform an unlawful, unsafe or mandatory-rule-compliant action.
Where these Terms conflict with a mandatory applicable rule of law, the mandatory rule prevails.
4. Customer Responsibility for the Travelling Group
The person making the Booking must have legal capacity to enter into the transaction and be authorised to provide information concerning the travelling group.
The Customer is responsible for providing accurate information and for ensuring that other Passengers receive material Booking information, safety requirements and travel conditions.
Where the Customer books on behalf of other Passengers, actions and decisions made through the Customer's account in relation to that Booking are treated as having been made on behalf of the travelling group, subject to mandatory law.
5. Booking Methods
Compare Offers
The Customer may submit journey details and receive commercial offers from suitable independent Carriers.
The Customer selects the preferred offer. The selected Carrier and offer price are identified before final confirmation and payment of that offer.
Carrier offer prices may be lower or higher than the Book-Go Instant Price.
Book-Go Instant Price
The Customer may accept the Instant Transfer Price displayed by Book-Go without selecting the final Performing Carrier.
Book-Go then arranges for a suitable Contracting Provider, RCP or other appropriate transport partner to be engaged for the Transport Service.
The final Performing Carrier may be assigned after confirmation of the Booking.
Individual or Special Offer
For non-standard routes, VIP services, large groups, multiple stops, special vehicles, complex timings or other specific requirements, the Customer may request an individual offer.
Such an offer becomes binding only after the Customer accepts its conditions and the Booking is confirmed.
6. Conclusion and Confirmation of a Booking
The Customer must complete the required Booking information and accept the displayed price and conditions.
The Booking confirmation records the information known and accepted at that time.
For Compare Offers, the selected Carrier or offer is identified through the marketplace process.
For Instant Bookings, the Contracting Provider, RCP and/or final Performing Carrier may be assigned after Booking confirmation in accordance with the applicable booking model.
Selection of an offer or initiation of a payment does not by itself constitute a successfully confirmed Booking until the required payment has been received and/or the applicable Book-Go confirmation has been issued through the Booking process.
The Customer must check the confirmation promptly and report any errors.
Book-Go may refuse or suspend a Booking where the information is materially incomplete, contradictory, fraudulent, technically impossible to fulfil or would require unlawful or unsafe conduct.
7. Transfer Price and Advance Payment
The Customer is shown the Transfer Price for the particular Booking.
Where the Customer selects a Booking with an Advance Payment, part of the Transfer Price is paid at the time of Booking. Unless expressly stated otherwise for the particular Booking, the standard Advance Payment is 20% of the Transfer Price.
The Advance Payment forms part of the Transfer Price and is not an additional charge added to the Transfer Price.
Example:
Transfer Price: EUR 500
Advance Payment: EUR 100
Remaining Balance: EUR 400
The Advance Payment is not presented to the Customer as Book-Go commission, Book-Go remuneration, a booking fee or a separate legal component of the Carrier's remuneration.
Commercial settlements between Book-Go and its partners, Book-Go remuneration, the RCP contractual amount and the Performing Carrier's remuneration are commercial matters separate from the concept of the Customer's Advance Payment and do not in themselves change the Customer's Transfer Price, Advance Payment or Remaining Balance.
For Compare Offers, the Customer is bound by the Transfer Price of the offer selected by the Customer and by the payment conditions displayed for that Booking.
8. Payments and Payment Options
Depending on the Booking method, different payment options may be offered to the Customer.
Advance Payment
The Customer pays the Advance Payment stated in the Booking, and the Remaining Balance is paid in accordance with the payment instructions for the particular confirmed Booking and the applicable Contracting Provider/RCP/Carrier model.
Full Payment
Where full payment is available for the particular Booking, the Customer may pay the entire amount shown in the relevant checkout through the Book-Go payment flow.
Full Payment Protection
Where Full Payment Protection is offered to the Customer and selected by the Customer, it is a separate optional Book-Go payment and payment-protection service.
The price of Full Payment Protection is 3% of the applicable Transfer Price calculation base, subject to a minimum of EUR 5 and a maximum of EUR 50, unless otherwise required for the particular Booking by mandatory law.
The Full Payment Protection price is displayed separately from the Transfer Price before payment is confirmed.
Full Payment Protection is not a credit-card surcharge and is not an escrow service.
Where, under the Full Payment Protection payment model, Book-Go controls settlement of the Transport Service payment, the relevant amount is released for settlement in accordance with the Book-Go system rules after completion of the journey and the 24-hour incident-notification period, provided that no problem or other justified settlement hold has been registered.
9. Payment of the Remaining Balance
Where a Remaining Balance exists after the Advance Payment, its recipient, payment method and due time are specified in the payment instructions for the particular confirmed Booking.
Depending on the booking model, Book-Go may send the Customer a payment link or other payment instructions, or the Remaining Balance may be payable to the Contracting Provider, RCP or Carrier.
Subject to the conditions of the particular Booking and the methods accepted by the Carrier, the Customer may also pay by payment link, card, cash or another previously agreed and lawful payment method.
The Customer is required to pay the confirmed Remaining Balance in accordance with the Booking conditions even where the recipient of that amount is not Book-Go.
10. Booking and Payment Confirmation, Fiscal Invoices and Taxes
Following a successful payment, Book-Go may provide the Customer with a Transfer Voucher / Booking & Payment Confirmation.
Such Voucher may include the Booking reference, Transfer Price, Advance Payment or other payment received, Remaining Balance, refunded amount, Booking status, cancellation information and other material Booking information.
The Voucher is a Booking and payment confirmation and is not a fiscal invoice for the Transport Service.
Where the Customer requires a fiscal invoice, the Customer should contact Book-Go. The appropriate fiscal invoice or other accounting document will be prepared according to the legal structure of the particular transaction, the actual service provider, the payment recipient and the applicable tax and accounting rules.
Book-Go is not responsible for calculating the Carrier's taxes. The Carrier, RCP or other relevant service provider is responsible for the tax, VAT, accounting and invoicing obligations applicable to its own remuneration under the laws applicable to it.
Book-Go is responsible for complying with the tax and accounting requirements applicable to Book-Go's own services and remuneration.
The fact that Book-Go technically administers or facilitates a payment does not in itself mean that the entire Transfer Price paid by the Customer constitutes Book-Go revenue for passenger transport.
11. Currency and Currency Conversion
Book-Go prices and payments are stated in EUR unless expressly stated otherwise.
Where the Customer uses a card or account denominated in another currency, the Customer's bank, card issuer or payment service provider may convert the payment into EUR.
Exchange-rate differences, bank conversion fees and other third-party currency costs are borne by the Customer and are not Book-Go revenue.
Book-Go does not apply a payment-method surcharge where such a surcharge is prohibited by applicable law.
12. Customer Booking Information
The Customer must provide accurate and complete information reasonably required to organise the journey, including name, contact details, pickup and destination, date, fixed pickup time, passenger count, luggage, special equipment, children and child-seat requirements, relevant flight, train or bus/service information, planned additional stops, pets and accessibility requirements.
Book-Go and the Carrier may plan the service in reliance on the information supplied by the Customer.
Incorrect or incomplete information may result in additional costs, delay, inability to make requested changes or refusal to provide an unsafe or unlawful service.
13. One-Hour Error-Correction Period
Where a Booking is made more than 24 hours before pickup, the Customer has 60 minutes from creation of the Booking to cancel or correct a genuine Booking error.
If the Booking is cancelled during this period, 100% of the amounts received from the Customer by Book-Go in connection with the relevant Booking will be refunded.
Where the Customer purchased Full Payment Protection, its price will also be refunded in full in such a cancellation.
This period is intended for errors such as an incorrect date, time, route or accidental duplicate Booking.
It does not apply to a Booking created less than 24 hours before pickup.
14. Booking Changes
More than 7 days before pickup, the Customer may request changes without a Book-Go administrative change fee. Where the actual transport requirements change, the Transfer Price may change.
Between 7 days and 24 hours before pickup, changes are subject to Carrier availability and may result in additional costs.
Less than 24 hours before pickup, changes are not guaranteed and are accepted only where legally, technically and operationally possible.
Material changes may require Carrier reconfirmation, price recalculation, a new offer or Book-Go administrative approval.
Until a change is expressly confirmed, the original Booking remains in force.
A simple request does not by itself change the pickup time, route, passenger count or other Booking conditions.
15. Customer Cancellation and Refund Policy
The following policy applies to cancellation of a Customer Booking:

The refund percentage is calculated by reference to the entire confirmed Transfer Price, not only the amount initially paid. Therefore, payment of an Advance Payment does not by itself create more favourable cancellation rights than full payment.
The amount actually refundable cannot exceed the amount actually received from the Customer by the relevant party and refundable under the applicable Booking and payment structure.
Where the Customer has selected Full Payment Protection, the price of that service is normally non-refundable in the event of voluntary Customer cancellation after the 60-minute error-correction period because the protection/payment service has already been activated, except where mandatory law requires otherwise.
These contractual conditions apply subject to mandatory consumer-protection rules and do not remove rights that cannot lawfully be restricted by contract.
16. Carrier Cancellation or Inability to Provide Confirmed Transport
Where the confirmed Carrier cannot provide the Transport Service, Book-Go and/or the Contracting Provider/RCP may take reasonable steps to find an equivalent replacement.
Where an equivalent replacement is available, the Customer is not required to pay a higher Transfer Price solely because the original Carrier did not perform the journey.
Where the confirmed Transport Service cannot be provided and no suitable replacement is available, the Customer is entitled to a 100% refund for the relevant unprovided Booking from the amounts collected in connection with that Booking.
Where the Customer purchased Full Payment Protection, its price will also be refunded in full in such a case.
17. Processing of Refunds
Where a refund is due, Book-Go will initiate any refund under its control without undue delay and in accordance with applicable law.
Where technically possible, Book-Go aims to initiate an approved refund within 14 calendar days.
The time required for the refund to appear in the Customer's account may additionally depend on the card issuer, bank or payment service provider and is not entirely within Book-Go's control.
Where the relevant payment was made directly to a Carrier or another payment recipient, technical execution of the refund may also depend on that payment recipient and the applicable payment system.
18. Fixed Pickup Time
Each Booking is made for a specific confirmed pickup time. The Customer must be ready to depart at that time.
The free waiting period does not convert the booked time into a flexible arrival window.
The fixed pickup time changes only following express confirmation through the Book-Go system or by the Carrier where the applicable Booking process authorises the Carrier to confirm such a change.
19. Pickup at an Airport, Railway Station or Public Bus/Coach Station
Pickup at an airport, railway station or public bus/coach station includes 60 minutes of free waiting time from the confirmed booked pickup time.
The relevant flight, train or bus/coach service information is used for monitoring and operational planning; it does not automatically move, restart or indefinitely extend the booked pickup time or free waiting period.
Where a delay to the relevant flight, train or bus/coach service becomes known and may affect pickup, the Customer must inform Book-Go or the Carrier as soon as possible.
The Customer must not assume that the Driver can wait indefinitely merely because a flight, train or bus/coach service number or other relevant service information has been provided.
20. Waiting at Other Pickup Locations
At hotels, apartments, private homes, villas, restaurants, offices, resorts and other fixed pickup locations that are not an airport, railway station or public bus/coach station, 20 minutes of free waiting time are included from the booked pickup time.
For example, a Booking for 08:00 means that the Customer must be ready at 08:00. The period until 08:20 is a waiting allowance, not a new scheduled pickup window.
21. Customer Delay and Duty to Inform
Where the Customer knows or reasonably expects to be delayed, the Customer must inform Book-Go or the Carrier as soon as possible.
Where the delay is already known before boarding an aircraft, train, bus, ship or before entering an area without communications, the Customer must provide notice before becoming unreachable.
Timely notice may allow the Carrier to offer paid waiting or a Booking change, but notice itself does not guarantee that the Driver will be able to alter the Driver's operational schedule.
22. Paid Waiting
After the free waiting period expires, the Carrier may, where operationally possible, offer to continue waiting.
Additional waiting is calculated according to the hourly waiting rate stated for the particular Booking or service and according to the charging increment specified for the Booking.
Paid waiting does not create an unlimited right to retain the vehicle or Driver.
Priority is given to subsequent confirmed bookings, Driver working- and rest-time requirements, safety and mandatory law.
23. No-Show
Where the Customer does not appear, the Carrier should reasonably document arrival at the correct location, time, attempts to contact the Customer and other material circumstances.
After expiry of the free waiting period, the Customer may be classified as a No-Show where the Customer has not appeared, has not appropriately provided notice, cannot be reached or refuses an applicable paid-waiting arrangement.
A justified No-Show results in a 0% refund, subject to mandatory law.
24. Free Break During the Journey
Each private transfer includes one free rest or toilet break of up to 15 minutes.
It is not an Extra Stop. Unused break time has no monetary value, cannot be transferred to another Booking and cannot be accumulated for a longer free stop.
Where the journey is materially extended by exceptional congestion or similar circumstances, the Driver may take additional free safety/rest breaks on the Driver's own initiative. They will normally not exceed 15 minutes and will not normally occur more frequently than once every two hours after the previous break, unless safety or law requires otherwise.
25. Extra Stops
A planned additional stop must be declared and booked in advance.
Examples include collecting or dropping off an additional passenger, another hotel or address, shopping, a restaurant, a sightseeing location, collecting belongings or another planned deviation from the route.
A pre-booked Extra Stop of up to 30 minutes costs EUR 30.
Where the stop exceeds 30 minutes, the price is EUR 30 plus the hourly waiting rate applicable to the particular service for the period exceeding 30 minutes.
Material additional kilometres, route deviation, tolls, parking or other transport costs may be charged additionally.
An unplanned stop during the journey is possible only with the Carrier's agreement and may be refused where it conflicts with legal requirements, safety, Driver working-time requirements or subsequent bookings.
26. Change of Pickup or Destination Address
A minor location correction is free where the new point is no more than 1 km from the original location and increases the journey by no more than 10 minutes.
A material address change occurs where the new location is more than 1 km away or increases the journey by more than 10 minutes.
Where such a change is requested at pickup, after the Driver has arrived or during the journey, a EUR 50 Book-Go Address Change Fee and additional Carrier transport costs may apply.
The Carrier must approve the change.
Payment of the fee does not create a right to require a change that cannot legally, safely or operationally be performed.
27. Passenger Count
The Customer must state the actual expected number of passengers.
This is used for vehicle assignment, luggage planning, child-seat provision, operational planning, regulatory compliance and transport documentation where required.
Where an entire private vehicle is booked, the price is normally for the private transport solution rather than for individual seats.
However, the maximum capacity advertised for a category does not mean that every unused seat is reserved for undeclared additional passengers.
28. Passenger-Count Changes Notified in Advance
Where the Customer informs Book-Go in advance of an increase in passenger count, no automatic per-person surcharge applies where the Carrier approves the change, the same vehicle may lawfully carry the new total number, the luggage fits, no larger or additional vehicle is required and there is no other material transport change.
The Customer must nevertheless provide the correct expected number before the journey so that the Carrier can prepare the service and required documentation.
29. Undeclared Additional Passengers
Where more passengers arrive at pickup than stated in the confirmed Booking, the Carrier is not required to transport them.
Where the Carrier can lawfully, safely and operationally accommodate them, a charge starting from EUR 30 for each undeclared additional passenger may apply.
The Carrier may expressly waive this surcharge.
Payment does not guarantee carriage.
Where a larger or additional vehicle is required, the actual additional transport costs apply.
The Carrier is not required to change an otherwise suitable assigned vehicle merely because the Customer failed to state the correct passenger count.
30. Vehicle Capacity, Assignment and Substitution
The Carrier must provide a vehicle suitable for the confirmed passenger count, declared luggage and the requirements of the booked category/service.
For a particular journey, the vehicle and Driver assigned by the Carrier may be displayed in the Book-Go system.
Unless expressly guaranteed otherwise, a Booking does not guarantee an exact make, model, colour, registration number, particular Driver or seating configuration.
Where operationally necessary, the Carrier may change the assigned Driver or vehicle provided that the replacement is suitable, lawful and complies with the confirmed Booking requirements.
An equivalent or higher-category vehicle may be provided.
Where the booked product expressly guarantees minimum capacity or a particular feature, the replacement must preserve that requirement.
A free upgrade does not create a right to carry undeclared additional passengers.
31. Luggage
The Customer must state the expected amount and type of luggage.
A reasonable difference in the number of luggage items does not by itself result in a surcharge where all luggage still fits safely, normally and lawfully within the vehicle's intended luggage capacity.
Where undeclared luggage materially exceeds capacity, the Carrier may refuse to carry the excess or, where possible, offer a larger/additional vehicle or another lawful solution.
Additional transport required because of undeclared excessive luggage is payable by the Customer.
The Carrier is never required to overload a vehicle, occupy necessary passenger seats, interfere with use of seat belts, Driver visibility or road safety, or exceed lawful load/capacity limits.
32. Special and Oversized Equipment
Skis, snowboards, bicycles, golf equipment, pushchairs, wheelchairs, oversized luggage and other items that materially affect vehicle capacity must be declared in advance.
Where the declared items fit safely within the booked vehicle, no automatic surcharge applies merely because the item is present.
Where larger or additional transport is required, the Customer bears the relevant additional costs.
33. Children and Child Restraint Systems
Children must be declared during Booking.
The Customer must provide information reasonably required to arrange an appropriate and lawful child-safety solution.
Requirements for child seats and restraint systems are determined by the mandatory laws applicable to the particular journey.
Where transport cannot lawfully be performed because the Customer failed to declare a child or required restraint system, the Carrier may refuse or delay the journey until a lawful solution is available.
34. Pets and Assistance Animals
Pets must be declared in advance.
Their transport is subject to Carrier approval, vehicle suitability, reasonable Carrier conditions and applicable EU and national law.
Any possible charge should, where possible, be disclosed in advance.
Recognised assistance or service animals are assessed separately.
Mandatory accessibility, disability and non-discrimination rules prevail over ordinary pet rules.
35. Accessibility and Mobility Requirements
Wheelchairs, mobility aids and special assistance requirements must be notified in advance, including dimensions or whether equipment is foldable where relevant.
Book-Go does not guarantee a specially adapted vehicle unless such a solution has been expressly confirmed.
Mandatory accessibility and non-discrimination rules always prevail.
A Carrier cannot be required to provide a service that cannot be safely or lawfully performed using the assigned vehicle, but Book-Go and the Carrier must handle declared requirements in accordance with law.
36. Road Closures, Snow, Weather and External Disruption
A journey may be affected by heavy snow, avalanche risk or control, road, mountain-pass or tunnel closures, accidents, exceptional congestion, police restrictions, border restrictions, strikes, natural events or other circumstances outside reasonable control.
The Carrier may use a safe and lawful alternative route.
Where an external event causes justified material additional kilometres, time, tolls, parking or unavoidable transport costs, an additional charge may be proposed.
Where reasonably possible, the Customer should be informed before choosing whether to incur additional costs.
37. Estimated Journey Duration and Onward Connections
Journey times displayed or provided by Book-Go, Google Maps, other routing systems or the Carrier are estimates and are not guaranteed arrival times.
Traffic, weather, border controls, road conditions and other factors may materially alter actual journey duration.
The Customer is responsible for allowing a reasonable time margin for a flight, train, bus, cruise, appointment or other onward connection.
Book-Go and the Carrier are not automatically liable for a missed connection caused by circumstances outside reasonable control.
This does not exclude liability imposed by mandatory law for legally attributable fault.
Travel insurance is recommended for wider travel risks.
38. Passenger Conduct
The Carrier may refuse to begin or may terminate a journey where a Passenger is violent or aggressive, threatens the Driver or other persons, materially interferes with safe driving, fails to comply with lawful safety instructions, smokes or uses an e-cigarette contrary to applicable rules, engages in unlawful activity, carries prohibited items or is intoxicated to an extent that makes transport unsafe.
Where the service cannot reasonably be provided because of inappropriate conduct by the Customer or Passenger, no refund is automatically due, subject to mandatory law.
39. Cleaning and Damage
Customers and Passengers are responsible for damage or exceptional cleaning requirements caused by them, including deliberate damage, broken equipment, material staining, vomiting or other contamination requiring professional cleaning or repair.
Any charge must be based on reasonable and documented actual costs rather than an arbitrary penalty.
Where a material charge is claimed, the Carrier must provide appropriate evidence.
40. Dangerous and Prohibited Items
The Carrier is not required to transport an item whose carriage is unlawful, creates a disproportionate safety risk, breaches transport or road-traffic rules, requires an unavailable special authorisation or may materially endanger persons or damage the vehicle.
The Customer is responsible for ensuring that items presented for transport are lawful and suitable for carriage.
41. Carrier Technical Failure, Operational Inability and Replacement
Where a vehicle technical failure or another problem on the Carrier's side prevents the journey from starting or continuing, the Carrier, Contracting Provider/RCP and/or Book-Go must take reasonable steps to find a suitable replacement where possible.
Where a suitable replacement cannot be provided, the Customer is entitled to an appropriate refund for the Transport Service not provided, subject to these Terms and applicable law.
Arranging a replacement does not make Book-Go a Carrier.
42. Carrier Subcontractors
The Contracting Provider or RCP may use another appropriately authorised Carrier where permitted by law.
The subcontractor must comply with applicable licensing, insurance, safety and operational requirements.
Use of a subcontractor does not automatically release the Contracting Provider/RCP from the obligations it assumed in relation to the particular Transport Service.
Commercial settlements between the Contracting Provider/RCP and the Performing Carrier are separate from the Customer's Transfer Price and Book-Go's internal commercial structure.
43. Carrier Responsibility
Subject to applicable law, the Carrier and, where applicable, the Contracting Provider/RCP is responsible for the Transport Service attributable to it, including the Driver, vehicle, technical condition, licences, permits, insurance, passenger safety, lawful capacity, required transport documentation and actual performance of the journey.
The Carrier is also responsible for compliance with local transport regulation applicable to the particular service.
44. Book-Go Responsibility
Book-Go is responsible for the Book-Go Service and its own legally attributable acts or omissions, including, where applicable, operation of the platform, booking administration, Book-Go communications, administration of payments controlled by Book-Go and Booking information generated by Book-Go.
Book-Go does not become a Carrier merely because it identifies a Carrier, displays an offer, facilitates a Booking or payment, arranges engagement of a Contracting Provider/RCP, provides platform communications or assists in finding replacement transport.
45. Liability Limitations and Mandatory Rights
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable EU or national law.
Any limitation applies only to the maximum extent lawfully permitted.
Mandatory consumer rights and legally non-excludable liability remain unaffected, including, where applicable, liability for death, personal injury, fraud, intentional conduct or any other matter that the law does not permit to be excluded.
Neither Book-Go nor the Carrier is automatically liable for indirect or consequential loss arising solely from circumstances outside reasonable control, but this provision does not remove liability imposed on the relevant party by mandatory law.
46. Complaints, Incidents and Evidence
The Customer should submit a complaint or report a problem as soon as possible and, where relevant, provide the Booking reference, description of the issue, time and location, photographs, receipts, communication records or other reasonable evidence.
Where the Customer uses Full Payment Protection and the issue may affect settlement of the protected payment, the Customer must register the issue as soon as possible and, where applicable, within the 24-hour incident period following completion of the journey.
Book-Go handles complaints concerning the Book-Go Service and may assist with communication concerning the Transport Service.
The relevant Carrier/Contracting Provider is responsible for actual performance of the transport.
Customers are encouraged, where possible, to report other transport issues within 7 days, but a longer mandatory statutory right is not lost solely because the complaint was not submitted within 7 days.
47. Reviews, Ratings, Fraud Prevention and Records
Book-Go may invite genuine Customers to submit reviews and ratings concerning completed or otherwise authentic Bookings.
Where such functionality is available on the platform, a review or rating may relate to the Carrier/company and/or the Driver assigned to the particular journey.
Reviews must not contain unlawful, threatening, abusive or knowingly false content.
Book-Go may retain and use Booking, status, payment, communication, Driver/vehicle assignment and other operational records where lawfully necessary for accounting, fraud prevention, dispute resolution, regulatory compliance, safety or legitimate operational purposes, subject to the Privacy Policy and applicable data-protection law.
48. Privacy, Communications and Disclosure of Data to Carriers and Drivers
Personal data is processed in accordance with the Book-Go Privacy Policy and applicable data-protection law.
Carrier and Driver access to Customer information must be limited to what is reasonably necessary for evaluating, performing, administering, communicating about or documenting the Booking.
Before confirmation of a commercial relationship or Booking, Book-Go may restrict disclosure of direct contact details between the Customer and a potential Carrier.
Communications necessary for performance of a confirmed Booking may take place through the Book-Go platform conversation between the Customer, the relevant Carrier/Partner and the Driver assigned to the particular journey.
The Driver does not need to be given access to the Customer's payment data, Book-Go internal financial information or other information that is not required to perform the particular journey.
A Book-Go administrator may access Booking communications where necessary for customer support, safety, dispute handling, fraud prevention or Booking administration.
49. Governing Law
The contractual relationship between the Customer and the Book-Go Platform Operator is governed by the laws of the Republic of Latvia, subject to applicable EU law, mandatory consumer-protection rules and other mandatory provisions that cannot lawfully be excluded by contract.
For a consumer, the choice of Latvian law does not deprive the consumer of mandatory protection that would otherwise apply under applicable conflict-of-laws rules.
The individual Transport Service may additionally be subject to mandatory transport, licensing, insurance, safety, tax and other laws of the country or jurisdiction applicable to the Carrier and the particular journey.
50. Disputes
Customers are encouraged first to contact Book-Go at info@book-go.eu so that the matter can be reviewed and, where necessary, communication with the Carrier can be coordinated.
Nothing in these Terms removes any mandatory consumer right to bring a claim before a competent court, consumer-protection authority, legally available alternative dispute-resolution mechanism or to use another remedy provided by applicable law.
51. Severability and Interpretation
Where any provision is invalid, unlawful or unenforceable in a particular jurisdiction, it applies only to the maximum extent lawfully permitted, while the remaining provisions continue in effect to the extent legally possible.
These Terms should be interpreted clearly and practically.
Where mandatory consumer law requires a particular interpretation or grants non-excludable rights, those mandatory rules prevail.
52. Changes to These Terms
Book-Go may update these Terms from time to time.
A confirmed Booking is normally governed by the version of the Terms in force when the Booking was created or accepted, unless a later change is required by mandatory law or is otherwise validly agreed.
A later version does not retroactively remove contractual or mandatory rights already acquired by the Customer in relation to a confirmed Booking.
53. Language
Book-Go may make these Terms available in multiple languages.
Each language version is intended to reflect the same commercial and legal principles.
Translations are prepared from the approved master version while preserving the same legal and economic meaning.
Where ambiguity arises in a translation, it must be interpreted in accordance with mandatory consumer-protection rules and the actual Booking information displayed to and accepted by the Customer.
54. Complete Booking Information and Priority of Specific Conditions
These Terms must be read together with the Booking confirmation, the accepted Carrier offer where applicable, checkout information, payment-method and Full Payment Protection information, confirmed Extra services, confirmed changes, relevant Carrier information and the Privacy Policy.
A specific individually agreed condition recorded in the Booking prevails over a conflicting general standard provision to the extent permitted by applicable law.
An informal request does not change a Booking until it has been confirmed through the procedure applicable to that Booking.
